These Terms of Use ("Terms") govern the use of the mobile app Iceland Explorer (hereinafter "App") and the website icelandexplorer.app (hereinafter "Website"), operated by Markus Leiter, Fichtenstrasse 8, 9230 Flawil, Switzerland (hereinafter "we" or "Operator").

By using the App or the Website, you agree to these Terms of Use.

1. Scope

These Terms apply to all users of the App and the Website. The App is designed as a digital travel guide for Iceland, providing information about points of interest, routes, and travel tips.

2. Description of Services

Iceland Explorer offers the following features:

• Interactive map with points of interest (POIs) in Iceland
• Curated routes with distance information
• Travel companion mode with live position and arrival detection
• Favorites list for personal trip planning
• Safety information and emergency contacts

The basic version of the App is available free of charge. Extended features are available as a paid Premium subscription or one-time purchase. The exact prices and included services are transparently displayed in the respective App Store and within the App. The purchase terms of the respective App Store (Apple App Store / Google Play) apply.

3. Important Notices Regarding Use

3.1 No Substitute for Professional Navigation

The App displays points of interest and routes on a map and can redirect you to external navigation apps (Apple Maps, Google Maps). The App itself does not provide turn-by-turn navigation and does not replace the use of a proper navigation system.

3.2 Personal Responsibility

Iceland is a country with sometimes extreme weather and road conditions. You are personally responsible for:

• Checking current road and weather conditions before every drive (road.is, vedur.is)
• Assessing whether a route or destination is suitable for your vehicle and experience level
• Adequate preparation (clothing, provisions, communication devices)
• Compliance with all local laws and regulations

3.3 Accuracy of Information

We strive to keep all information (coordinates, descriptions, opening hours, distance data) up-to-date and accurate. However, conditions on the ground can change at any time. In particular:

• Roads may be closed or impassable
• Points of interest may be temporarily closed
• Travel time and distance figures are estimates
• GPS coordinates may be slightly inaccurate

4. Disclaimer

Use of the App and the Website is at your own risk. We assume no liability for:

• Damages arising from the use or non-use of the information provided
• The accuracy, completeness, or timeliness of the displayed content
• Damages due to technical malfunctions, GPS inaccuracies, or lack of internet connection
• Damages caused by redirection to external apps (Apple Maps, Google Maps)
• Personal injury or property damage in connection with visiting locations displayed in the App

This limitation of liability does not apply to damages attributable to willful intent or gross negligence on our part, nor to cases where mandatory legal provisions provide for liability.

5. Intellectual Property

5.1 App and Website

All content of the App and the Website (texts, design, code, graphics, logos) is protected by copyright and owned by the Operator, unless otherwise indicated. Reproduction, distribution, or use beyond personal use requires express written consent.

5.2 Image Material

The images used in the App and on the Website are sourced from the following providers and are subject to their respective license terms:

• Pexels – Free for commercial and non-commercial use (Pexels License)
• Unsplash – Free for commercial and non-commercial use (Unsplash License)
• Wikimedia Commons – Under the respective Creative Commons licenses
• Own screenshots – App screenshots are the property of the Operator

5.3 Map Data

Route data is based on OpenStreetMap (OSRM) and is used under the Open Database License (ODbL). Map rendering is provided by Apple MapKit (iOS) or Google Maps (Android).

6. Availability

We strive to provide the App and the Website without interruption. However, there is no entitlement to permanent availability. We reserve the right to modify, extend, or discontinue the App or individual features at any time.

7. Amendments to the Terms of Use

We reserve the right to amend these Terms of Use as needed. The current version is always available through the App and the Website. In the event of significant changes, we will notify you via the App or the Website. Continued use after a change constitutes acceptance of the updated terms.

8. Governing Law and Jurisdiction

Swiss law applies, excluding conflict of laws rules and the UN Convention on Contracts for the International Sale of Goods.

The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms of Use is Flawil, Switzerland, unless mandatory legal provisions require a different jurisdiction.

For consumers residing in the EU: You may also assert claims before the competent courts of your country of residence. The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr.
